Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, products, and services provided by CrestAlgo, a trade name of Sky Pioneers, a sole proprietorship (eenmanszaak) registered in the Netherlands (KVK: 92956076). By accessing our website at crestalgo.com or purchasing any of our products, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Definitions

  • "CrestAlgo," "we," "our," or "us" refers to Sky Pioneers, trading as CrestAlgo, registered at the Netherlands Chamber of Commerce (KVK) under number 92956076.
  • "Products" refers to all software tools, indicators, addons, and digital products offered by CrestAlgo, including but not limited to TradingView indicators and NinjaTrader addons.
  • "Services" refers to the website, educational content, blog posts, community access, and any other services provided by CrestAlgo.
  • "User," "you," or "your" refers to any individual or entity accessing our website or purchasing our products.
  • "Whop" refers to Whop, Inc., the third-party platform through which CrestAlgo processes payments, manages subscriptions, and delivers digital product access.

2. Nature of Our Products

CrestAlgo is a software publisher registered under SBI code 58290 (Other software publishing). Our products are technical analysis and risk management software tools designed to assist traders in analysing financial markets.

Our products are tools, not advice. CrestAlgo does not provide financial advice, investment advice (beleggingsadvies), trading signals, or portfolio management services. We are not regulated by the Dutch Authority for the Financial Markets (Autoriteit Financiële Markten, AFM) and do not hold any financial services licence. All trading decisions are made solely by the user. Please read our Financial Disclaimer for full details.

3. Licence Grant and Restrictions

When you purchase a CrestAlgo product, you are granted a limited, non-exclusive, non-transferable, revocable licence to use the software for your personal or internal business use, subject to these Terms.

You may:

  • Install and use the product on the platform for which it is designed (e.g., TradingView, NinjaTrader) in accordance with that platform's own terms
  • Use the product for your own trading analysis and decision-making

You may not:

  • Redistribute, resell, sublicence, share, or transfer your access to any other person or entity
  • Copy, modify, reverse-engineer, decompile, or create derivative works from our products
  • Use our products to provide services to third parties or operate a commercial signal service
  • Remove or alter any proprietary notices, labels, or marks on our products
  • Share your account credentials or access codes with anyone else
  • Use the products for any unlawful purpose

Violation of these restrictions may result in immediate termination of your licence without refund.

4. Subscriptions, Payments, and Billing

All purchases are processed through Whop (whop.com). By purchasing a product, you also agree to Whop's Terms of Service and Privacy Policy.

  • Pricing: All prices are displayed inclusive of applicable taxes where required. VAT (BTW) at the applicable rate is charged in accordance with Dutch and EU tax law.
  • Recurring subscriptions: If you purchase a subscription, it will automatically renew at the end of each billing cycle (monthly or annual, as selected) unless you cancel before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your Whop account. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the period you have already paid for.
  • Payment methods: Payment methods are those supported by Whop and may include credit/debit cards and other methods as available on the platform.

5. Refund Policy

Because our products are digital goods that are delivered immediately upon purchase, the EU right of withdrawal (herroepingsrecht) does not apply once you have accessed the product, in accordance with Article 6:230p(f) of the Dutch Civil Code and Article 16(m) of the EU Consumer Rights Directive.

By completing a purchase and accessing the product, you acknowledge and consent to the immediate delivery of digital content and waive your right of withdrawal.

If you experience a technical issue that prevents the product from functioning as described, please contact us at support@crestalgo.com within 14 days of purchase. We will investigate and, at our discretion, provide a resolution which may include troubleshooting assistance, a replacement, or a refund.

6. Intellectual Property

All products, content, designs, code, algorithms, documentation, trademarks, and other materials on crestalgo.com are the intellectual property of CrestAlgo (Sky Pioneers) and are protected by Dutch and international copyright, trademark, and intellectual property laws.

Nothing in these Terms transfers any ownership rights to you. Your licence to use our products is limited to the rights expressly granted in Section 3.

7. User Responsibilities

You are responsible for:

  • Ensuring that your use of our products complies with all applicable laws and regulations in your jurisdiction
  • Your own trading decisions and outcomes — CrestAlgo bears no responsibility for any trades you execute or any financial losses you incur
  • Maintaining the confidentiality of your account credentials
  • Ensuring you have the appropriate platform (TradingView, NinjaTrader, etc.) and subscription level to use our products

8. Disclaimer of Warranties

Our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • Our products will meet your specific trading requirements or expectations
  • Our products will be error-free, uninterrupted, or free of bugs
  • Any particular trading result or financial outcome will be achieved through the use of our products
  • The data, signals, or analysis generated by our products will be accurate or timely at all times

Market conditions change. Past performance of any indicator or tool does not guarantee future results.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CrestAlgo, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, trading losses, or business interruption, arising out of or in connection with your use of our products or services, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to these Terms or our products shall not exceed the total amount you have paid to CrestAlgo in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for matters where liability cannot be excluded under applicable Dutch or EU law, including fraud or wilful misconduct.

10. Third-Party Platforms

Our products are designed to operate on third-party platforms such as TradingView and NinjaTrader. CrestAlgo is not affiliated with, endorsed by, or sponsored by these platforms. Your use of these platforms is governed by their respective terms and conditions. We are not responsible for any changes to, outages of, or issues with third-party platforms that may affect the functionality of our products.

Payments are processed by Whop, a third-party payment and subscription platform. CrestAlgo does not store or process your payment card details. All payment data is handled by Whop in accordance with their security and privacy practices.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our website or products after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users (e.g., via email or a notice on our website).

12. Termination

We reserve the right to suspend or terminate your access to our products and services at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to our business or other users.

Upon termination, your licence to use our products is immediately revoked. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law) shall continue to apply.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in the district of Midden-Nederland (Almere/Lelystad), unless mandatory consumer protection rules in your jurisdiction require otherwise.

If you are a consumer resident in the EU, you may also use the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to submit a complaint.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
